Do I need to urgently change my OSAGO policy to a new one?

The fact is that for many motorists, as well as for a significant part of traffic police inspectors, the status of an e-car citizen is not entirely clear, namely its actual belonging to legally competent documentation.

Indeed, the digital age is entering all spheres of people's lives with such rapid speed that not everyone has time to form a serious attitude to its fruits.

Not everyone is mentally ready for e-OSAGO policies to accept their documentary usefulness, and many have a quite reasonable question: is there a boy, speaking in the manner of a well-known aphorism.

In what form exactly should an e-policy exist as a tangible and legal document? In the form of just an "electronic card" or in the form of a tandem with a paper carrier? And which of them is more important, and is it a document at all?

Classic DPS claim under e-policy during the transition period

Since October 1, 2015, after the full implementation of electronic OSAGO (since July 1, only an extension was available), there have been many cases of illegal traffic police fines for motorists on the roads on the basis of their lack of a proper motor vehicle policy.

And the main claim that the road guards made when the driver presented the e-OSAGO printout from the home printer was something like the following:

- What are you doing to me, citizen, your linden fuss? Are you generally in a sober state that you allow yourself to show a photocopy of it to the inspector instead of the OSAGO policy ?!

That's it, despite the comical nature of such a message, there is a rational grain of logic here: the driver really shows the policeman some kind of black-and-white "copier", without live signatures and seals, and brazenly announces that he is fully competent, because although purchased at home, from a laptop, but in a decent company and for decent money.

Electronic policy as a valid e-document

But the truth is that this printout really does not have any eligibility, because it is just a printout and is a mirroring of a real document, which, in turn, does not exist on our physical plane with you in the usual office tangible form.

That is, a photocopy, as a “document”, when compared, has a greater “significance”, because it assumes the presence of a physical document, and in our case, the e-policy cannot even boast of this.

Conclusion: CMTPL e-policy provides for complete virtuality

The conclusion to be drawn from this section is as follows:

  • Duplicate policy on a full-fledged paper form-carrier, e-insurance is not mandatory.
  • printout An electronic policy itself does not have independent legal significance, since it is impossible to determine the validity of insurance without involving databases from the network.
  • Appearance of an electronic policy does not play a significant role, even if it is a “real” virtual document, since only the information in the databases and its reliability are important.

Also, for a better understanding of the essence, I will give a very vivid analogy with money: there is paper money and for their “wrong printout” they can easily be put in jail, and there is electronic money that is already familiar to everyone, which does not even have a sham appearance, but nevertheless however, they are equal in value to paper ones.

What does an electronic OSAGO policy look like?

In the photo below, you can see what a completed OSAGO e-policy looks like. Its important difference from paper is that it does not and should not have any obvious or hidden visual security elements - they are completely unnecessary here, because here it is not the image on the screen or on the printout that needs protection, but the contents of information databases .

In the articles describing the electronic policy, this is said like this: “there is no usual protective micro-pattern, but it is just as green ...”. You should not pay attention to this at all - the micro-pattern and other security markers visible through the screen and reflected on the printout can be easily imitated.

But the people are slowly accustomed to a new informational perception, so the policy looks like just a green-looking document. Moreover, the new paper policies are no longer green, but of a complex iridescent-lilac color, which was introduced this year to combat counterfeiting and.

Electronic ones don’t care what color they will be: it’s not at all necessary to print it on a color printer - an ordinary black and white one will fit perfectly, because only information, and not color or even the structure of the document, has some significance there. In principle, you can even copy everything that is on the monitor by hand on paper - the result is the same.

Document Header: Bullets 1 and 2

Here there is the main visual difference of the e-policy - it is called: "Electronic insurance policy".

There is also a difference in the serial number: instead of CCC or EEE, XXX is listed here. But this alphanumeric identifier itself is the most important information, even more than in paper - it is on it that, first of all, cars determine the ownership of insurance.

This is where one of the main benefits of electronic insurance lies - as experts say, the probability of a client receiving an electronic clone (with the same serial number) is zero, since similar machines will be immediately detected.

Term and periods of insurance: markers 3 and 4

Everything is standard here: the car is insured for a year, with the exception of temporary policies. Also with the periods of use - the corresponding dates are written, just like in the paper version.

Policyholder and owner: markers 5 and 6

I think you know who the insured and the owner are - the insured insures the car with an insurance company (with the insurer), and the owner uses insurance and this is not necessarily the same person. Therefore, the fields for each are separate.

Data of vehicles and drivers with access to its management: markers 7 and 8

Here are the basic information about the car: model / brand, VIN code or body number, license plate, as well as the series / number of the vehicle passport (PTS) and the purpose of operation.

The block below lists the persons authorized to drive the machine, indicating their full name and series/number driving license(VU).

Immediately after these blocks are the usual general information items that you still need to read - they can change.

The next two blocks show the cost of the policy (insurance premium) and special notes. The latter are also important, because in e-insurance, this is where the place of purchase of insurance (website address) and the number of the paid online order are usually prescribed.

Dates, signature and seal: markers 11 to 13

As on a paper policy, there are two dates below: the date of conclusion of the contract and the date of issue of the policy (usually they coincide).

The surname and initials of the insurance specialist - the representative of the insurer, with his signature and the seal of the insurance company are also spelled out.

Here it is necessary to clarify that both the seal and the signature, no matter how beautiful they look, but this is just a facsimile. What is a facsimile? This is an exact copy of any graphic original: literally, this term means “do the same”, translated from Latin. That is, the same as the signatures on banknotes, for example. Their corresponding significance is purely introductory.

But there is an important difference at the bottom of the e-policy - the absence of a personal signature of the client (insured). In place of the signature there is only the inscription "Insurant" and there is not even a facsimile imitation.

According to the rules of electronic insurance, the client's signature is replaced by the buyer's authorization in his account, where he provides all his data. Yes, this is all somewhat strange, but without a live signature, an e-document is considered effective, but a paper one is not, of course.

What to present to traffic police inspectors and what problems may arise

Now about the main thing: how does the driver need to prove that he has paid in good faith for OSAGO and its printout is really a reflection of a real-life online contract, and not a work in Photoshop.
To date, according to clause 2.1.1 (paragraph 6) of the SDA, as well as clause 1 of Art. 32 FZ No. 40, driver of the vehicle:
«… is obliged to have with him an OSAGO policy or information printed on paper on the conclusion of an OSAGO in the form of an electronic document…»

How can your electronic policy be checked by an inspector

According to the job description, the traffic police inspector, having received information from you that you have an electronic motor vehicle citizen, is obliged to verify the details provided (serial number of the policy, state number of the vehicle, VIN code or body number) with the database available to him.

What are these bases? There are two of them at the disposal of the traffic police: the special service IMTS of the Ministry of Internal Affairs of the Russian Federation and the public base of the RSA (Russian Union of Insurers) already familiar to you. For verification, traffic police units must have the appropriate equipment - tablets or netbooks that have access to the network.

That is, in fact, the inspector only needs the network, your machine data and a computer device to check. He doesn't need a driver. But, according to the above provisions of the regulations, the inspector has the right to require the driver to provide a paper printout of the e-OSAGO.

Although it may not require this, since there are additionally intra-departmental circulars sent to all services of the State traffic inspectorate and recommending traffic police officers to check e-policies without requiring paper printouts. This is a letter of explanation of the Main Directorate of the Ministry of Internal Affairs No. 13/12-u-4440 (dated 07/03/2015) and an order to the GUOBDD of the Ministry of Internal Affairs of the Deputy Chairman of the Government of the Russian Federation I. Shuvalov No. 13/12-u-6112 (dated 09/04/2015).

That is, for now, the issue of providing / not providing a printout of the policy is being resolved on the spot - at the discretion of the traffic police officer, taking into account the available hardware verification capability or without. Accordingly, if there is no e-OSAGO printout in the car, this can be framed as a violation.

What to do in case of problems with traffic police on e-OSAGO

If there are frictions with the traffic police on the road under the e-policy (if you have a printout), then advise the inspector to read the current traffic rules and OSAGO rules governing the use of the e-policy. Otherwise, even now you can get undeserved sanctions from some policemen.

Despite the fact that today the driver is still required to have a printout of the e-policy in the car, auto experts do not see much point in it - if the inspector cannot check the e-policy over the network, then no printout will help here.

Yes, in many places and many traffic police crews do not yet have the equipment or access to the network for such checks, but this should not be a problem for drivers. Moreover, the above circulars indicate that in the absence of access to the network, the inspector is obliged to check the policy through the central dispatcher on the radio.

However, in remote areas of the Russian Federation, it is better to have a regular policy for the time being - satellite service Internet is not available everywhere there.

Regarding confirmation of the presence of an e-policy in the form of its printer printouts, the current situation requires clarification of this entire saga from the very beginning.

Presentation of a "photocopy" of the e-policy

As already mentioned, the e-policy does not imply a special paper carrier that serves to confirm the reliability of the fact of insurance - this is checked through the appropriate databases.

However, this innovation caused confusion among many traffic police officers. And at first, the PCA, for the sake of reassuring the inspectors, recommended that drivers carry printouts of e-OSAGO with them. This did little to help the confusion - some inspectors perceived the presented "photocopies" as a personal insult.

Moreover, some drivers did not show anything at all, arguing that the e-policy is subject to online verification and even the presence of its printout in the car is not legally fixed.

As it turned out in practice, it was not possible to promptly provide all traffic police units with the possibility of online checking of OSAGO. Therefore, a year after the introduction of e-OSAGO, the presence of a printout in the car was legally fixed in the Federal Law No. 40 (according to the Federal Law No. 214 of 06/23/2016) and in the traffic rules.

And on this the situation hung in the air, although attempts to resolve the issue did not stop completely. For example, in the spring of 2017, First Deputy Prime Minister Igor Shuvalov instructed the Ministry of Internal Affairs and the Ministry of Finance to work out further stages of the transition to e-policies from paper ones. The order focuses on the abolition of the requirement to have an e-OSAGO printout in the car and the complete transition of the autocitizenship to a purely electronic form.

Cancellation of the obligation to carry an e-OSAGO printout

But from the very beginning, Shuvalov's circular initiatives did not work out, and the government finally intervened with the participation and control of Medvedev. On October 17, 2018, the State Duma adopted bill No. 501904-7, which almost completely removes the difference between paper and electronic OSAGO.

According to paragraph 6 of Art. 2 of the bill (changes in clause 7 of article 15 of the Federal Law No. 40), all policies will have their own unique electronic identifier (not the serial number of the form), according to which they will be checked. Accordingly, there will be no need for protected forms of the paper version of OSAGO.

In addition, paragraph 15 (Art. 2) of the draft law excludes from paragraph 1 of Art. 32 40-FZ, the requirement to provide an e-OSAGO printout. Instead, it is indicated that the driver "...submits for verification the insurance policy of compulsory insurance." That is, it can be an original paper policy or a printout of it, a printout of an electronic version or its display on electronic gadgets.

That is, the driver will be obliged to provide the inspector with something from what he has (original, printout, scan, page personal account IC with e-OSAGO display, etc.). But if nothing is provided, then it can be counted as a violation (at the discretion of the inspector).

It is clear that the requirement to carry a printout is temporary, but for now, do as prescribed by law so as not to anger the servants of the striped wand.

When the innovations will come into force and what to do now

This bill will definitely be adopted, but it was sent for revision to the State Duma Committee on the financial market. After the document is finalized and if it is fully adopted in the second reading, the innovations will come into force 180 days after the official promulgation of updates in the OSAGO legislation (according to clause 1, article 4 of the bill).

In the meantime, the changes are not accepted, drivers with e-CTP are required to have a printout of the policy in the car. At the same time, for greater persuasiveness, insurers are advised to certify it in the office with a seal and signature, although this is not necessary. Also, if desired, the insured can take a printout of e-OSAGO to the UK on the official letterhead.

Will the obligation to present OSAGO to the inspector be canceled

In the foreseeable future, the obligation of the driver to present anything to the inspector regarding OSAGO will be completely excluded from the legislation - the employee will be obliged to independently check through the network the availability and validity of the policy according to the details of the car and / or owner.

But this is the final stage of the transition to e-OSAGO, and with its initiation, the relevant provisions will be removed not only from Federal Law No. 40, but also from the SDA. So far, this is not possible throughout the country due to unequal access to the network in different areas.

  • Write down all the data from the TCP literally when buying an e-policy online, as they are written there, even if there are inaccuracies: write like that, with inaccuracies - the main thing is that the car does not detect discrepancies, otherwise it will not work out of the house to get insurance.
  • Complete rejection of paper policies by cities in the plans of the Government: for this they will work on the appropriate technical equipment, so there will be no return to the previous system, keep this in mind.

From July 1, 2016, by the March decision of the Presidium Russian Union motor insurers (RSA), the introduction of new OSAGO forms, with enhanced protection against forgery, is underway.

And in this regard, it will be very useful for every motorist to imagine how a new type of policy should look like. In addition, there are questions on the network about some blocks on old forms, which are still issued and are fully relevant.

The clear orientation of the ordinary policyholder (client) in the design of the policy gives him significant advantages. This allows you to personally check the completed certificate at the place of conclusion of the contract with the insurance company (IC). After all, an accidental or intentional incorrect filling of an auto-citizenship can bring a lot of trouble in the future.

OSAGO policy forms are printed on Gosznak and have characteristics typical for the products of this enterprise:

  • Thick paper for documents, covered with a light green high-quality micro-mesh protective ornament;
  • The form has a watermark structure - "RSA" with the emblem of this organization;
  • Protective polymer fibers and a metallized strip are embedded in the body of the blank, which are visible from both sides;
  • Top left is unique for each document serial number, which has a relief embossing that is well felt on both sides.

By the way, the size of the insurance certificate is specially made in a slightly larger format (about 1 cm) than a standard A4 sheet.

OSAGO policies are of two types:

  • Single-layer - used in the offices of insurance companies, where all the data in the required fields is entered using a special printer.
  • Two-layer (self-copying) - with an additional yellow-white copy. They are intended mainly for freelance insurance agents who fill in the fields by hand and who need a copy to report before their insurance transaction.

Moreover, these two-layer policies have long been intended to be banned, tk. they are easily forged - in the right places with different iodine compounds and peroxide, inscriptions made ballpoint pen, and anything is written in their place. Visually distinguishing such chemistry is difficult.

The structure of the OSAGO insurance policy

Stamp

On the right side of the policy header there is a place for your insurer's stamp. Do not confuse it with the seal, which is placed at the very bottom. There are two options here:

  • Wet stamp;
  • Printer stamp.

Classic wet stamp - it contains a logo, the official name of the insurer, its physical address, phone numbers, website.

Corporate printer stamp - usually put by large companies. It, among other things, may contain a barcode for reading data about the insurer (can be determined from a smartphone): for example, RESO has it, but Rosgosstrakh does not.

Serial number

Located to the left of the name, the serial number contains 10 digits and three series letters.

Today (since April 1, 2015), insurance policies are issued with the EEE series, and before that it was preceded by the CCC series (issued until March 31, 2015) and BBB, but all of them practically do not differ in structure.

All serial numbers of issued certificates are strictly recorded in the AIS RSA database. Moreover, it is assumed that for each insurer an individual number range is allocated, by which it can be identified, but this applies only to large and medium-sized players in the insurance market.

Date fields

Below the heading there are two unmarked blocks with fields for entering dates - the first is smaller, the second is large.

It is precisely in these blocks that motorists often have questions: not everyone can understand why the policy has two date fields, and not one - sometimes they have the same values, and sometimes they differ.

You probably don't know this either? Now I will explain.

The fact is that the first (smaller) field indicates the start and end date of your insurance contract with the insurer, and this period is not the immediate period of insurance coverage.

That is, here OSAGO insurers have two concepts:

  • Insurance contract - in case of ordinary insurance, it is always concluded with you for a year (it can be less only in special cases).
  • An insurance period is a specific period (or several periods) during which you have insurance coverage.

The dates of the insurance contract are written in the first block. And the dates of the insurance period (periods) in the lower large - there you can specify up to 3 insurance periods within one year.

It is noteworthy that in the old forms of the "CCC" series this distinction was more clear, because in the small block there was an entry: "The term of the contract with ...". And in the new "EEE" series, it was replaced with a misleading phrase: "Insurance period from ...". Look at the comparison photo.

With the purpose of the date fields, I think everything is clear.

Extended policy

As you know, if a motorist is insured by the same insurer, he does not need to renew the contract every year - it is simply extended, and the policy form is replaced with another one-year one.

Its characteristic difference is that the values ​​of the first and second block of dates are the same, and a dash is put in all extra fields (of the second block).

But this is if the insurance period covers all 12 months of the year, and if it is less (three, six, nine months) - the so-called. seasonal insurance, then there will be other numbers in the second block. By the way, if for some reason the 3 available fields for the seasonal extension of insurance were not enough, then a corresponding additional tab is attached to the policy.

Marked points and blocks of the insurance form

Below the header are 8 paragraphs, some of which have blocks for entering data, while others do not.

Point one

The first paragraph is a solid block for entering information about the insured: full name. Please note that the insured and the owner of the car may be different persons.

Point two

The second paragraph is a block where you need to write down the basic data about the car: the name of the owner of the vehicle (V), make / model, the presence of a trailer, VIN code (or body number), license plate, serial number of any document to choose from (PTS or STS). Below you need to check the intended purpose of the vehicle (this is a new requirement).

Point three

The third paragraph has two block fields. In the small one, you need to indicate the type of insurance: with or without restrictions on the number of persons allowed to drive the vehicle. In a large one, list the full names of persons admitted to driving and indicate the serial number of their driver's license (VU).

Items four through six

These paragraphs are purely informational - they contain information of insurance legislation relevant for the period of conclusion of the contract on the insurance period, insured event, etc.

Point seven

This update was initiated in order to increase the level of protection of OSAGO forms from counterfeiting by an order of magnitude, a change in the structure was not planned, and the replacement of the color and ornamental design was used to sharply distinguish old, poorly protected documents from new ones.

Up to and including 2018, several other small changes were made to the insurance form, including the notes on the back. A photo of the new OSAGO policy allows you to make sure that it contains the same information as the old one (with the exception of a few points): the term of insurance, the data of the insured and the owner of the car, information about the vehicle, columns for entering persons admitted to driving, purposes of using the car, a table for calculating the size insurance premium. There is a column for special notes to be made by the insurer. The policy must indicate the date of conclusion of the contract of insurance "motor citizen", the signatures of the parties. Electronic OSAGO has the same columns with information, the same color, the same arrangement of all elements of the document.

Do I need to exchange OSAGO insurance policies for new ones?
