Subsidies are provided for the purpose of state support of research and innovation activities in the region to financially support the implementation of the research and development project (hereinafter - the R&D project) by regional enterprises with the involvement of educational institutions of higher education and scientific organizations located in the region ...

The recipients of the Subsidy are legal entities (with the exception of state (municipal) institutions), in respect of which, based on the results of the Competition, a decision was made to grant the Subsidy.

The amount of the Subsidy provided may not exceed 50 percent of the total cost of the R&D project specified in the application for the Subsidy. The maximum amount of the Subsidy provided to one recipient of the Subsidy in the current financial year is 3 million rubles.

Requirements for the participants of the Competition and the procedure for holding the Competition are determined by the decree of the Government of the region dated October 26, 2015 No. 887 "On approval of the Procedure for providing subsidies for the implementation of research and development work by enterprises of the region with the involvement of educational institutions of higher education and scientific organizations located on the territory region "(hereinafter referred to as the Subsidy Granting Procedure).

Requirements that the applicant must meet on the date of submission of documents for the Subsidy:

1) be registered as a legal entity on the territory of the Vologda Region for at least 1 year;
2) have among the species economic activity one or more types of economic activity included in the group of high-tech-level, medium-high-tech-level and high-tech industries, for calculating the indicator "Share of high-tech and science-intensive industries in the gross regional product" in accordance with Rosstat order of December 15, 2017 No. 832 "On approval of the Methodology for calculating the indicators" The share of products of high-tech and knowledge-intensive industries in the gross domestic product "and" The share of products of high-tech and knowledge-intensive industries in the gross regional product of the subject Russian Federation».

3) involvement in the implementation of the declared R&D project of an educational institution of higher education or a scientific organization located in the territory of the region, which has experience in the effective performance of work similar to the declared R&D project;

4) availability of production and technological equipment, equipment and instruments that ensure the performance of work under the R&D project;

5) the absence of a valid or previously terminated agreement on the provision of the Subsidy in connection with the violation by the recipient of the Subsidy of the conditions for its provision established by the Procedure;

6) consent for the Department and state financial control bodies of the region to carry out inspections of compliance with the conditions, goals and procedure for granting the Subsidy;

7) the absence of an unfulfilled obligation to pay taxes, fees, insurance premiums, penalties, fines, interest payable in accordance with the legislation of the Russian Federation on taxes and fees;

8) the absence of overdue debts for the return of subsidies to the regional budget, budget investments provided, including in accordance with other legal acts, and other overdue debts to the regional budget;

9) must not be in the process of reorganization, liquidation, bankruptcy;

10) must not be a foreign legal entity, as well as a Russian legal entity, in the authorized (pooled) capital of which the participation of foreign legal entities the place of registration of which is a state or territory included in the list of states and territories approved by the Ministry of Finance of the Russian Federation that provide a preferential tax regime for taxation and (or) do not provide for the disclosure and provision of information when conducting financial transactions (offshore zones) in relation to such legal entities, cumulatively exceeds 50 percent;

11) must not receive funds from the regional budget on the basis of other regulatory legal acts for the purposes specified in clause 1.3 of the Procedure for granting a Subsidy.

Requirements that an R&D project must meet: >

1) result orientation:
creation (manufacturing) and testing of a prototype (pilot batch) of a new type of product according to previously developed sets of design and technological documentation intended for serial (small-scale) production in the region;
development of new technologies and improvement of the technical level of products intended for production in the region;
2) focus on achieving performance indicators of the use of the Subsidy;
3) the possibility of selling products manufactured using R&D results in conditions of reasonable risk and a real market;
4) the availability of confirmation of the objectivity of calculating the amount of subsidies requested from the regional budget;
5) the total term of the R&D project is no more than 24 months.

List of documents for obtaining the Subsidy:

To receive the Subsidy, the applicant (authorized representative), no later than the established deadline for accepting applications, submits to the Department of Economic Development of the region an application for the provision of the Subsidy in the form established by the Department of Finance of the region, with the following documents attached (hereinafter - the application):

1) the applicant's questionnaire in the form in accordance with Appendix 3 to the Procedure for granting a subsidy;
2) passports of the R&D project in the form in accordance with Appendix 4 to the Procedure for granting subsidies;
3) terms of reference for an R&D project in the form in accordance with Appendix 5 to the Procedure for granting a subsidy;
4) the schedule of the R&D project in the form in accordance with Appendix 6 to the Procedure for granting a subsidy;
5) cost estimates for the implementation of the R&D project at the expense of the Subsidy in the form in accordance with Appendix 7 to the Procedure for granting subsidies with the attachment of the calculation of the requested Subsidy for the implementation of the R&D project with supporting documents justifying the price structure for the work, deciphering the amount of costs by item of expenditure, work financing plan , cost estimates and other documents;
6) cost estimates for the implementation of the R&D project at the expense of the applicant's own (borrowed) funds in the form in accordance with Appendix 8 to the Procedure for granting subsidies;
7) copies of a document certifying the authority of the person to act on behalf of the applicant;
8) copies of the constituent document with all applicable amendments to it as of the date of filing an application for a Subsidy;
9) copies of documents confirming the availability at the time of filing an application for a Subsidy of production and (or) technological equipment necessary for the implementation of an R&D project, or the possibility of its use (balance sheet, invoices, turnover sheets, invoices, sales and purchase agreements) and other documents);
10) documents (or their copies) confirming the effectiveness of R&D carried out earlier by educational institutions of higher education and scientific organizations located in the region (positive reviews, and (or) letters of recommendation from enterprises (previous customers), and (or) acts of introduction of the results of research and development work into production, other documents) (if any);
11) documents (or their copies) confirming the possibility of selling products manufactured using the results of the R&D project (letters of guarantee from potential enterprises - customers of the results of the R&D project, and (or) supply or contract agreements, including preliminary ones, and (or) protocols of intent, and (or) reports on marketing research of the market for the future product, other documents);
12) the list of educational institutions of higher education and scientific organizations involved in the implementation of the R&D project located on the territory of the region;
13) copies of documents confirming the involvement of educational institutions of higher education and scientific organizations located in the region in the implementation of the R&D project (contracts for the provision of services, co-execution, including preliminary, and (or) protocols of intent, other documents);
14) documents (or their copies) confirming the provision of the R&D project with its own or attracted sources of financing (extracts from the applicant's current account, and (or) money loan agreements, and (or) credit agreements, a letter of guarantee);
15) presentation of the R&D project in PowerPoint format, reflecting the relevance, goals, objectives, main stages of the R&D project, the expected final results of the R&D project and their competitive advantages, the strategy for commercializing the results of the R&D project, the economic effect;
16) consent for the Department and state financial control bodies to carry out inspections of compliance with the conditions, goals and procedure for granting the Subsid in the form in accordance with Appendix 10 to the Procedure for granting subsidies;
17) the applicant's certificate confirming that the applicant, on the first day of the month of filing the application, has no overdue debt for the return of subsidies, budget investments and other overdue debt to the regional budget in accordance with other legal acts;
18) certificates of the tax authority on the fulfillment by the taxpayer (tax payer, payer of insurance premiums, tax agent) of the obligation to pay taxes, fees, insurance premiums, penalties, fines, interest as of the first day of the month of filing the application;
19) extracts from the Unified State Register of Legal Entities (extracts from the Unified State Register of Individual Entrepreneurs) issued as of the first day of the month the application was submitted;

The applicant has the right to submit other documents confirming the information set forth in the application, as well as confirming the compliance of the applicant and the R&D project with the requirements imposed on them, at the applicant's discretion.

The applicant submits an application in one copy in writing.

All information in the application must be in Russian and legible.

Copies of documents must be certified by the applicant and presented with the presentation of their originals for verification with the submitted copies.

When a document is submitted in a language other than Russian, it must be accompanied by a translation into Russian, certified by the applicant.

Documents that have erasures or postscripts, crossed out words in the text, documents executed in pencil, as well as documents with damages (paper) that do not allow reading the text and determining its full or partial semantic content (absence of part of words, numbers or sentences ).

24. In case of violation by the organization - the recipient of the subsidy, the conditions established during its provision, due to the occurrence of force majeure circumstances, the penalties are not applied to the organization - the recipient of the subsidy.

25. Information on the amount and timing of the transfer of subsidies is taken into account by the Ministry of Industry and Trade of the Russian Federation when forming a forecast of cash payments from the federal budget, which is necessary for drawing up a cash plan for the execution of the federal budget in accordance with the established procedure.

26. The organization - the recipient of the subsidy, after the completion of the research and development work, is obliged to annually submit to the Ministry of Industry and Trade of the Russian Federation a report on the achievement of performance indicators for the implementation of the complex investment project in the form established by the subsidy agreement.

If the achievement of performance indicators for the implementation of a complex investment project is provided for in a period exceeding the period for granting the subsidy, the organization - recipient of the subsidy also submits an interim report before the planned date for achieving performance indicators for the implementation of the integrated investment project.

27. The Ministry of Industry and Trade of the Russian Federation and the state financial control bodies are obliged to carry out inspections of compliance by organizations with the goals, conditions and procedure for granting subsidies.

1. Rules for the provision of subsidies to Russian organizations to compensate for part of the costs of research and development work incurred in 2017-2019 as part of the implementation of complex investment projects to organize the production of rehabilitation equipment

1. These Rules establish the goals, conditions and procedure for the provision of subsidies from the federal budget to Russian organizations to compensate for part of the costs of research and development work incurred in 2017-2019 as part of the implementation of complex investment projects to organize the production of rehabilitation means ( further, respectively - organizations, subsidies).

2. In these Rules, the term "complex investment project" means a set of interrelated activities and processes for creating products for the rehabilitation industry market, limited in time and resources, which may include:

scientific research work;

development work;

organization of the release of a trial batch of products;

approbation (trial operation) of products in order to improve the technical and consumer properties of the product;

commercialization of completed research and development work.

3. Subsidies are provided under the scientific research and experimental developments in civilian industries "of the state program of the Russian Federation" Development of industry and increasing its competitiveness "(hereinafter - the state program) in order to stimulate the activities of organizations in the field of the rehabilitation industry in 2017-2019 for the development and production of goods that are intended for individuals with disabilities (sick, disabled, elderly people, children, women during pregnancy, childbirth and the postpartum period) and are focused on creating, along with other members of society, equal opportunities for life, including technical means of rehabilitation (including medical complexes and equipment, systems of mechanical correction of the musculoskeletal system, prostheses of organs and limbs), as well as products and devices that provide a barrier-free living environment for people with disabilities (hereinafter referred to as products), which will help to achieve the performance indicators of the implementation of a comprehensive investment project established by the state program.

4. Subsidies are provided within the budgetary allocations provided for by the federal law on the federal budget for the corresponding financial year and planning period, and the limits of budgetary obligations communicated in the prescribed manner to the Ministry of Industry and Trade of the Russian Federation as a recipient of federal budget funds for the purposes specified in paragraph 1 of these Rules.

Subsidies are provided to organizations that have passed a competitive selection for the right to receive subsidies, within the framework of technological areas determined in accordance with the list specified in paragraph 6 of these Rules, to reimburse the costs of research and development work as part of the implementation of complex investment projects, in which the term for the implementation of these works does not exceed 3 years (hereinafter referred to as the competition). The maximum amount of a subsidy provided to an organization is 200 million rubles, including for approbation (trial operation) of products - no more than 30 million rubles (if any).

5. Subsidies are provided to organizations that, as of the date no earlier than the 15th day of the month preceding the month in which it is planned to conclude an agreement on the provision of subsidies, the following conditions:

a) the organization has no unfulfilled obligation to pay taxes, fees, insurance premiums, penalties, fines and interest payable in accordance with the legislation of the Russian Federation on taxes and fees;

b) the organization has no overdue debts to return subsidies to the federal budget, budget investments provided in accordance with other legal acts, and other overdue debts to the federal budget, including monetary obligations to the Russian Federation, as defined in;

c) the organization is not in the process of reorganization, liquidation or bankruptcy;

d) the organization is not a foreign legal entity, as well as a Russian legal entity, in the authorized (pooled) capital of which there is a share of participation of foreign legal entities whose place of registration is a state or territory included in the list of states and territories approved by the Ministry of Finance of the Russian Federation that provide preferential the tax regime of taxation and (or) not providing for the disclosure and provision of information during financial transactions (offshore zones), in aggregate exceeds 50 percent;

e) the organization does not receive funds from the federal budget in accordance with other regulatory legal acts for the purposes provided for in paragraphs 1 and 3 of these Rules;

f) a complex investment project refers to one of the technological areas determined in accordance with the list specified in paragraph 6 of these Rules.

6. The list of technological areas in which the granting of subsidies will be carried out is determined by the Scientific and Technical Council for the Development of Production of Industrial Products of a Rehabilitation Orientation under the Ministry of Industry and Trade of the Russian Federation.

7. The subsidy is provided to compensate for the following actually incurred and documented expenses of the organization within the framework of a comprehensive investment project:

a) the cost of remuneration of workers directly involved in the performance of research and development work, experimental design work, work on the release of a trial batch of products, work on approbation (trial operation) of products (but not more than the average salary for a given constituent entity of the Russian Federation for the previous quarter), as well as the costs of compulsory pension insurance, compulsory social insurance in case of temporary disability and in connection with maternity, compulsory medical insurance, compulsory social insurance against industrial accidents and occupational diseases, accrued on the specified amounts of labor costs;

b) overhead costs in the amount of not more than 100 percent of the amount of labor costs directly related to the implementation of a complex investment project, including approbation (trial operation) of products;

c) the cost of work (including the services of third parties in the event of their involvement, including individuals- disabled people and legal entities that attract disabled people) under contracts for the implementation of research and development work directly related to the implementation of a comprehensive investment project, including approbation (trial operation) of products;

d) expenses for the manufacture of prototypes, models and stands, including the purchase of materials and components, as well as the approbation (trial operation) of products;

e) expenses for the production of a pilot batch of products and its testing, certification and (or) registration, as well as testing;

f) expenses under contracts for the lease of technological equipment and technological equipment necessary for carrying out research and development work;

g) expenses for the manufacture and (or) purchase of tooling, testing, measurement and control tools, consumable tools for approbation (trial operation) of products;

h) expenses under contracts of life and health insurance of persons participating in the approbation (trial operation) of products (if any), created as part of a comprehensive investment project, in the absence of these conditions in contracts subject to compensation in accordance with subparagraph "c" of this paragraph.

8. The organization is obliged to keep separate records of the costs of the project.

9. The competition is held by the Ministry of Industry and Trade of the Russian Federation no more than 4 times a year.

The Ministry of Industry and Trade of the Russian Federation makes a decision to hold a tender, taking into account the budgetary allocations provided for by the federal law on the federal budget for the corresponding financial year and planning period, and the limits of budgetary obligations brought in the established manner to the Ministry of Industry and Trade of the Russian Federation as the recipient of federal funds. budget for the purposes specified in paragraphs 1 and 3 of these Rules, as well as taking into account the limits of budgetary obligations necessary to complete the provision of state support for complex investment projects in accordance with previously concluded agreements for the provision of subsidies.

10. In the process of ensuring the preparation of the competition, the Ministry of Industry and Trade of the Russian Federation:

a) determines the performance indicators of the implementation of complex investment projects for each technological area;

b) determines the requirements for the content and design of a business plan for a complex investment project submitted for participation in the competition, and places them on the official website of the Ministry of Industry and Trade of the Russian Federation in the information and telecommunications network "Internet" (hereinafter referred to as the "Internet" network);

c) form the tender commission and approve the regulations on the tender commission;

d) determines the minimum volume of sales of innovative products in technological areas, which will be created using the results of research and development work, indicating it in the tender documentation;

e) approves the methodology for the examination of the results of the implementation of a complex investment project and places it on its official website on the Internet.

a) receipt of total proceeds from the sale of products manufactured within the framework of a comprehensive investment project in an amount that is 2 times the size of the subsidy provided for the performance of research, development and production of a trial batch of products, or in the amount , exceeding 3 times the size of the subsidy provided for approbation (trial operation) of the product, in proportion to the subsidy received by cost directions within no more than 3 years after the start of production under the project.

b) the number of newly created and modernized high-performance jobs within the framework of the implementation of a comprehensive investment project, which is at least 50 percent of the number of employees directly involved in the implementation of research and development work within the framework of a comprehensive investment project;

c) the ratio of the amount of the subsidy and the amount of extra-budgetary funds planned to be attracted for the implementation of a comprehensive investment project, which must be at least 2 times higher than the amount of the requested subsidy, except for the costs of approbation (trial operation) of the product (if any);

d) the number of patents and (or) production secrets (know-how) received;

e) the term for the implementation of the complex investment project (the time period in which it is supposed to ensure the achievement of all the declared performance indicators of the implementation of the complex investment project, including during the approbation (trial operation) of the product), but not more than 6 years;

f) the volume of exports of products that will be created in the course of the implementation of a comprehensive investment project, but not less than 1 percent of the total volume of products produced for the specified period.

12. For the purpose of holding a tender, the Ministry of Industry and Trade of the Russian Federation shall post on its official website on the Internet a notice of the tender, indicating the timing of its holding and tender documentation, containing the following information:

a) the procedure, place, start date and end date for the submission of envelopes with applications for participation in the tender (hereinafter referred to as the application);

b) requirements for the form and composition of the application;

c) the procedure for making changes to the tender documentation;

d) place, order, date and time of opening envelopes with applications;

e) draft agreement on the provision of subsidies.

13. To participate in the competition, organizations submit the following documents (stitched, numbered sheet by sheet, sealed by the organization's seal (if any), in a sealed envelope):

a) application;

b) passport of the complex investment project in accordance with Appendix No. 2;

c) information on the average number of employees of the organization for the year preceding the calendar year of filing the application, submitted in the form approved by the Federal Tax Service, as well as a certificate of the presence in the staff of the organization of personnel of at least 15 people, signed by the head of the organization and certified by the seal (if available ) organizations;

d) a certificate, drawn up in any form, on the availability of total revenue for 36 months preceding the month of filing the application, at least 50 million rubles, signed by the head of the organization and certified by the seal (if any) of the organization, with copies of supporting documents attached;

e) a certificate, drawn up in any form, on the provision of the organization with technological and testing equipment for the implementation of a complex investment project, owned or on another legal basis by the organization or its subsidiaries or organizations in relation to which it is a subsidiary located in the territory Russian Federation, signed by the head of the organization and certified by the seal (if any) of the organization, with copies of supporting documents attached;

f) copies of documents confirming that the organization has the necessary for the implementation of a comprehensive investment project and belonging to it on the right of ownership or on another legal basis of buildings, structures and structures, the rights to which are not registered in the Unified State Register of Rights to Real Estate and Transactions with It;

g) a certificate, drawn up in any form, on the presence of successful experience in the implementation of such complex investment projects, including on their conclusion to the planned payback, ensuring the achievement of the planned performance indicators of the implementation of the complex investment project, signed by the head of the organization;

h) certificate of the name of the product, which will be created in the course of the implementation of the complex investment project;

i) a certificate from the tax authority confirming the absence of the organization as of the date no earlier than the 15th day of the month preceding the month in which it is planned to conclude an agreement on the provision of a subsidy, an unfulfilled obligation to pay taxes, fees, insurance premiums, penalties, fines, and interest payable in accordance with the legislation of the Russian Federation on taxes and fees (if the organization fails to submit such a document, the Ministry of Industry and Trade of the Russian Federation requests it independently);

j) information on the implementation by the organization at the time of filing the application of work on the implementation of a complex investment project at the expense of its own and (or) borrowed funds, indicating the amount of actual costs incurred and work performed;

k) a business plan for a comprehensive investment project, including a marketing analysis with a justification of demand for products that will be created during the implementation of a comprehensive investment project, indicating the performance indicators of the implementation of a comprehensive investment project at the end of each six months of its implementation, including a schedule for the implementation of a comprehensive investment project, containing key events and results of the implementation of the specified project, including the qualitative and quantitative characteristics of the achievement with the use of subsidies of performance indicators of the implementation of a complex investment project, as well as the structure of the planned costs associated with the implementation of a complex investment project, providing for research and development - design work, production and sale of products, as well as attracting investments in the form of borrowed or own funds of the organization (hereinafter, respectively - a business plan, a plan j), containing, among other things, information:

on the technical characteristics of products planned for development as part of research and development work and used to create products as part of a comprehensive investment project;

on the volume of production and sales of products that will be created in the course of the implementation of a comprehensive investment project;

about the amount of the subsidy;

on the share of innovative products in the total volume of products manufactured by the organization;

on the number of patents expected to be obtained;

on the number of newly created and modernized high-performance jobs within the framework of the implementation of a comprehensive investment project;

on the time frame for the implementation of a complex investment project;

on the volume of exports of products that will be created in the course of the implementation of a comprehensive investment project;

on the financial indicators of the implementation of a complex investment project - net present value and internal rate of return;

l) letters of guarantee from investors (co-investors) and (or) credit institutions about their readiness to provide financial support for the costs associated with the implementation of a complex investment project, if necessary, to attract credit funds for the implementation of a complex investment project. These letters must contain data on the effectiveness of the planned investments in a complex investment project, obtained on the basis of an analysis of the business plan;

m) an extract from the Unified State Register of Legal Entities, certified in accordance with the established procedure (if the organization fails to submit such a document, the Ministry of Industry and Trade of the Russian Federation requests it independently);

o) a certificate signed by the head of the organization, confirming the compliance of the organization as of the date no earlier than the 15th day of the month preceding the month in which it is planned to conclude an agreement on the provision of a subsidy, the requirements established by subparagraphs "b" - "e" of paragraph 5 of these Of the Rules;

o) a program for approbation (trial operation) of products (if carried out), which is created as part of the implementation of a comprehensive investment project and is developed in accordance with the requirements established by the methodology for approbation (trial operation) of innovative rehabilitation products with the participation of disabled people, approved by the Ministry of Industry and trade of the Russian Federation;

p) a copy of the registration certificate for a medical device (provided that the product being developed is a medical device) when reimbursing the costs of implementing a comprehensive investment project at the stage of approbation (trial operation) of the product.

14. The conditions for admission of organizations to the competition are:

a) compliance of the submitted documents with the requirements provided for in clause 13 of these Rules, and the submission of these documents in full;

b) the accuracy of the information contained in the submitted documents;

c) the absence of conflicting information in the submitted documents;

d) compliance of the application with technological directions determined in accordance with the list provided for in paragraph 6 of these Rules;

e) the organization does not have previously concluded agreements with the Ministry of Industry and Trade of the Russian Federation for the provision of subsidies included in the register of complex investment projects for organizing the production of rehabilitation means, within the framework of which the subsidy provided for in paragraph 21 of these Rules is provided.

15. Complex investment projects, the implementation of which has been started by the organization independently, may be accepted for competitive selection.

16. As part of ensuring the holding of the competition, the Ministry of Industry and Trade of the Russian Federation:

a) registers, in the order of receipt, envelopes with applications and documents specified in clause 13 of these Rules in a special journal, which must be laced, numbered sheet by sheet and sealed with the seal of the Ministry of Industry and Trade of the Russian Federation;

b) opens the envelopes with applications and documents in the manner and within the time specified in the notice of the tender, and checks the correctness and completeness of the documents provided for in paragraph 13 of these Rules. Based on the results of opening these envelopes and checking organizations for compliance with the conditions for admission to the tender provided for in paragraph 14 of these Rules, a protocol of opening envelopes with applications and documents is drawn up, containing a list of organizations admitted to participate in the tender, which is signed by all members of the commission present and posted on the official the website of the Ministry of Industry and Trade of the Russian Federation on the Internet, no later than 1 business day following the day the envelopes are opened;

c) verifies, within 10 working days from the date of signing the protocol of opening envelopes with applications and documents, the compliance of documents with the conditions for granting a subsidy and compiles a rating of applications in accordance with the criteria specified in paragraph 11 of these Rules according to the methodology provided by Appendix No. 1 to these Rules. Based on the ratings of applications, the competition commission assigns a serial number to each application. Based on the results of the assessment and comparison of applications, a protocol for the assessment and comparison of applications is drawn up no later than 3 working days following the day of the end of the assessment and comparison of applications. The protocol for evaluating and comparing applications is drawn up in 1 copy, which is kept by the Ministry of Industry and Trade of the Russian Federation;

d) within 5 working days from the date of signing the protocol for evaluating and comparing bids, transfers to the winner (winners) of the tender a copy of the protocol for evaluating and comparing bids and a draft agreement on the provision of a subsidy attached to the tender documentation and containing the conditions for the execution of the contract proposed by the winner of the tender in the bid. The protocol for evaluating and comparing applications is posted on the official website of the Ministry of Industry and Trade of the Russian Federation on the Internet no later than 1 business day following the day of its signing;

e) signs an agreement on the provision of a subsidy with the winner (winners) of the competition or with the only participant admitted to participate in the competition not earlier than 10 working days and not later than 20 working days from the date of posting on the official website of the Ministry of Industry and Trade of the Russian Federation in the network " Internet "protocol for evaluation and comparison of applications.

17. If the winner of the tender refuses to conclude an agreement on the provision of a subsidy, the Ministry of Industry and Trade of the Russian Federation shall conclude an agreement with the organization that took the place next to the place occupied by the organization recognized as the winner of the competition.

18. Based on the results of the tender, an agreement is concluded between the Ministry of Industry and Trade of the Russian Federation and the organization on the provision of a subsidy in accordance with the standard form established by the Ministry of Finance of the Russian Federation. The specified agreement must contain:

a) indicators of the effectiveness of the implementation of a complex investment project, including the criteria specified in paragraph 11 of these Rules, but not less than those declared by the organization at the competition;

b) the term for the implementation of a complex investment project, not exceeding the one declared by the organization for the competition;

c) a schedule containing key events in the implementation of a complex investment project in accordance with the business plan and the dynamics of their achievements;

d) the consent of the organization for the Ministry of Industry and Trade of the Russian Federation and the state financial control body to carry out inspections of compliance with the goals, conditions and procedure for granting subsidies established by these Rules and the subsidy agreement;

e) a schedule of financial support for the costs associated with the implementation of the investment project.

19. To receive a subsidy, an organization with which a subsidy agreement has been concluded shall submit to the Ministry of Industry and Trade of the Russian Federation no more than 1 time per quarter and no later than December 5 of the current year the following documents:

a) an application for the provision of a subsidy, drawn up in any form and signed by the head and the chief accountant (if any) of the organization, indicating the amount of the subsidy and the payment details of the organization;

b) a certificate of expenses incurred for the purposes specified in paragraph 3 of these Rules, signed by the head of the organization, with the attachment of documents confirming the organization's separate accounting of project costs, including extracts from accounting accounts;

c) copies of contracts, as well as primary accounting documents (invoices, acceptance certificates for work performed, invoices, payrolls), certified in the prescribed manner, confirming the implementation of the costs specified in paragraph 7 of these Rules;

d) a certificate from the tax authority confirming that as of the date not earlier than the 15th day of the month preceding the month in which it is planned to receive the subsidy, the organization has no unfulfilled obligation to pay taxes, fees, insurance premiums, penalties, fines and interest payable in accordance with the legislation of the Russian Federation on taxes and fees (if the organization fails to submit such a document, the Ministry of Industry and Trade of the Russian Federation requests it independently);

e) a report on the achievement of performance indicators for the implementation of a comprehensive investment project specified in the subsidy agreement and business plan, drawn up in the form established by the subsidy agreement, including during product approbation (trial operation);

f) a certificate signed by the head of the organization, confirming the compliance of the organization with the requirements established by subparagraphs "b" - "e" of paragraph 5 of these Rules.

20. The Ministry of Industry and Trade of the Russian Federation, within 10 working days, considers the documents submitted in accordance with clause 19 of these Rules in the order of their receipt and makes a decision on granting a subsidy or refusing to provide a subsidy. The grounds for refusing to provide a subsidy at the stages of the implementation of a complex investment project is:

a) deviation within 12 months of the actual values ​​of the performance indicators of the implementation of the complex investment project, provided for by the subsidy agreement and the business plan, by more than 30 percent from the planned values ​​of such performance indicators (cumulative total);

b) non-compliance of the submitted documents with the requirements established by clause 19 of these Rules, or failure to submit (submission not in full) of these documents;

c) unreliability of the information contained in the submitted documents;

d) the organization has overdue debt on monetary obligations to the Russian Federation, as defined in Article 93_4 of the Budget Code of the Russian Federation.

21. The Ministry of Industry and Trade of the Russian Federation maintains a register of complex investment projects for organizing the production of rehabilitation products, within the framework of which a subsidy is provided to compensate for part of the costs of research and development work, indicating the amount and sources of funding.

22. The transfer of the subsidy in the amount calculated in accordance with Appendix No. 3 is carried out no later than 10 business days from the date of the decision by the Ministry of Industry and Trade of the Russian Federation to provide the subsidy in the prescribed manner to the organization's current account opened with a Russian credit institution, no more than 1 time in the quarter of the fiscal year.

23. In case of violation by the organization of the conditions for granting a subsidy, as well as in case of failure to achieve the performance indicators of the implementation of a comprehensive investment project provided for by the subsidy agreement and the business plan, the subsidy shall be returned to the federal budget in the manner prescribed by the budget legislation of the Russian Federation, within 10 working days from the date of receipt of the corresponding request from the Ministry of Industry and Trade of the Russian Federation.

If, based on the results of the implementation of the investment project, at least one of the performance indicators of the implementation of a complex investment project specified in the agreement on the provision of a subsidy and a business plan is less than 70 percent of the value declared in the investment project and determined by the agreement on the provision of a subsidy, to the organization - the recipient of the subsidy is subject to penalties aimed at collecting the amounts used by such an organization in the framework of the investment project, the amount of which is determined in accordance with Appendix No. 4.

24. In case of violation by the organization - the recipient of the subsidy, the conditions established during its provision, due to the occurrence of force majeure circumstances, the penalties are not applied to the organization - the recipient of the subsidy.

25. Information on the amount and timing of the transfer of subsidies is taken into account by the Ministry of Industry and Trade of the Russian Federation when forming a forecast of cash payments from the federal budget, which is necessary for drawing up a cash plan for the execution of the federal budget in accordance with the established procedure.

26. The organization - the recipient of the subsidy after the completion of the research and development work is obliged to annually submit to the Ministry of Industry and Trade of the Russian Federation a report on the achievement of performance indicators for the implementation of the integrated investment project in the form established by the subsidy agreement.

If the achievement of performance indicators for the implementation of a complex investment project is provided for in a period exceeding the period for granting the subsidy, the organization - recipient of the subsidy also submits an interim report before the planned date for achieving performance indicators for the implementation of the integrated investment project.

27. The Ministry of Industry and Trade of the Russian Federation and the state financial control bodies are obliged to carry out inspections of compliance by organizations with the goals, conditions and procedure for granting subsidies.

1. The amount of the subsidy (S) is calculated using the formula:

where:

- the cost of remuneration of workers directly involved in the implementation of research and development work, for the period of their work within the framework of a comprehensive investment project;

- overhead costs associated with the implementation of a complex investment project;

- the cost of work (including the cost of services of third parties if they are involved) under contracts for the performance of research, development and technological work directly related to the implementation of a complex investment project;

- expenses for the manufacture of prototypes, models and stands, including the purchase of materials and components;

- the costs of manufacturing a pilot series of products and its testing, certification and (or) registration, as well as testing;

- expenses under contracts for the lease of technological equipment and technological equipment necessary for carrying out research and development work.

1. The amount of penalties (A) is calculated by the formula:


where:

- the achieved value of the i-th performance indicator of the implementation of the complex investment project specified in the agreement on the provision of subsidies, as of the expiry date of the implementation of the complex project;

- the planned value of the i-th indicator of the effectiveness of the implementation of the complex investment project specified in the agreement on the provision of subsidies;

- the proportion of the rating of the application, determined in accordance with Appendix No. 1 to the Rules for the provision of subsidies to Russian organizations to compensate for part of the cost of research and development work incurred in 2017-2019 as part of the implementation of complex investment projects to organize the production of funds rehabilitation approved by Decree of the Government of the Russian Federation of January 25, 2017 N 76 "On approval of the Rules for the provision of subsidies to Russian organizations to compensate for part of the costs of research and development work incurred in 2017-2019 as part of the implementation of complex investment projects on the organization of production of rehabilitation means ";
